CONSTRUCTIVE NOTICE

 

"He that rejecteth me, and receiveth not my words, hath one that judgeth him: the word that I have spoken, the same shall judge him in the last day," Joh 12:48.

The term "Constructive Notice" is a legal term, but I believe I can better illustrate my point with this term than in any other way. If you were to purchase a home, your first and most important question would be: Is the title clear of all judgments, liens and encumbrances?

The law provides that any person who has a just claim against such property must file that claim on the public record. This puts the public on notice of their claim.

Any purchaser will not be held responsible for any judgment lien or encumbrances which are not filed on the public record. If you were to buy a home, you are responsible to check the public record to see if there are any judgments, liens or encumbrances against its title.

Suppose that you would buy a home from a person you have known for many years, so you trusted his word that the title was clear and paid cash without checking the public record. If it was revealed soon after that he deceived you and in fact there was a judgment against your home, just the fact that it was someone you knew and trusted so well who had deceived you would not give you a valid defense.

You are charged with Constructive Notice! That means that the judgment was recorded on the public record, and had you checked the record you would have known. To be charged with Constructive Notice means you are held just as responsible as though you had actual knowledge, because if you had checked you would have known.

There are so many different religions, and they each have their own philosophy. God's Word warns us to, "Beware lest any man spoil you through philosophy and vain deceit, after the tradition of men, after the rudiments of the world, [or human reasoning], and not after Christ," Col 2:8. Our Saviour says, ". . . the word that I have spoken, the same shall judge [you] in the last day." You shall be judged by God's Word and not by any philosophy or anything you have been told.

If we neglect reading God's Word, our ignorance will not be a defense in the day of judgment. We will be charged with Constructive Notice. We all have God's Word available to us, and we shall be held just as responsible for knowing the words of our Saviour as though we had actual knowledge of His Words, because if we had checked we would have known.

Jesus said, ". . . the word that I have spoken, the same shall judge [you] in the last day." Oh, beloved, the words of our Saviour are, "Whosoever cometh to me, and heareth my sayings, and doeth them, I will shew you to whom he is like: He is like a man which built an house, and digged deep, and laid the foundation on a rock," Lu 6:47-48.

That Rock is Christ, and we are told in Re 19:13, ". . . and his name shall be called The Word of God." We are admonished to dig deep into the Word of God and lay our foundation upon His Word and not upon the philosophy of any man.

Jesus said, "Search the Scriptures; for in them ye think ye have eternal life: and they are they which testify of me," Joh 5:39. Amen.

Let avarice, from shore to shore
Her favorite god pursue;
The word, O Lord, we value more
Than India or Peru.
